Memo

In an effort to clarify and streamline the procedure for presentation of jury instructions in criminal cases in Klickitat County Superior Court, the following procedure shall be adhered to for upcoming trials, which is consistent with CrR 6.15.

1. Each party shall file a proposed set of instructions with the clerk of the court that include citations of authority and/or WPIC number no later than 3:00 p.m. on the day preceding the scheduled trial date.
2. Each party shall provide the court (presiding Judge) with a copy of the proposed instructions that include citations of authority and/or WPIC number no later than 3:00 p.m. on the day preceding the scheduled trial date.  Each party shall also provide the court (presiding Judge) an original of the instructions that shall not be numbered nor include citations of authority by 3:00 p.m. on the day preceding the scheduled trial date.
3. Each party shall serve a copy of their proposed instructions that include citations and/or WPIC number on the opposing party at the commencement of the trial.
4. Additional instructions that could not be reasonably anticipated shall be filed and served as soon as possible in the same number and manner as outlined above.

In short, each party shall file a cited proposed set of instructions with the clerk of the court, provide a cited and an uncited copy of the instructions to the presiding judge and serve a copy of the proposed cited instructions to the other party.
