FINAL DETERMINATION OF NON-SIGNIFICANCE DATE:February 6, 2012 PROPONENT:Klickitat County Planning Department REPRESENTATIVE: Curt Dreyer, Planning Director PROPOSAL: The proposal is to repeal and replace the Cluster Development District (CD) section of the County regulation (Section 2.24 of the Klickitat County Zoning Ordinance No. 62678, as amended and Klickitat County Code Title 19.50). This is a non-project action that does not propose or authorize any specific projects or activities. The proposed amendments are intended to provide flexibility on setback and lot size provisions for residential development in Extensive Agriculture (EA) and Open Space (OS) zones, encouraging the land owners to retain large, undivided parcels of land that provide opportunities for compatible agricultural and other rural land use. LOCATION OF PROPOSAL: The Cluster Agriculture Overlay may be superimposed over parcels zoned Extensive Agriculture (EA) and Open Space (OS). It is not limited to a specific site. INCORPORATION BY REFERENCE: Environmental resources within the County have been extensively evaluated through several EIS's, including: • The Klickitat County Energy Overlay EIS (2004; as supplemented by Addenda, 2011). The EOZ EIS evaluated impacts to the environment from energy development. • Southeast County Wind Project EIS's: (1) Windy Point II Wind Energy Project EIS (2009); (2) Harvest Wind Project EIS (2009); (3) Imrie Wind Project EIS (2009); (4) Juniper Canyon Wind Project EIS, including Revised EIS (2010); and (5) School Section Wind Project EIS (2010). These EIS's evaluated impacts from wind development within the Southeast portion of the County. • Sundoon Supplemental EIS (2011). The Sundoon EIS assessed impacts associated with a master planned residential/resort development in the Dallesport area. These EIS's are incorporated by reference, and are on file with the Klickitat County Planning Department. NOTICE OF NON-SIGNIFICANCE: Klickitat County has determined that the above described proposal, conducted in conformance with the applicable Klickitat County Codes and Ordinances, would not have a probable significant adverse impact on the environment, and an environmental impact statement is not required under RCW 43.21C.030(2)(c). This decision was made after review of a completed environmental checklist and other information on file with the Klickitat County Planning Department. COMMENT PERIOD: This final determination is issued pursuant WAC 197-11-340(2)(f). Klickitat County has considered comments on its preliminary determination of nonsignificance. There is no additional comment period. Any appeals of this decision must be filed under the County SEPA ordinance’s provision for appeals of a final DNS. Any appeal is therefore due no later than fifteen days from the date of final DNS issuance. Any appeal of this determination on the basis of noncompliance with the provisions of RCW 43.21C must be submitted in writing by 5:00 PM, Thursday, February 23, 2012. Appeals shall be in writing and filed with the County Auditor. Appeals shall state with specificity the basis for the appeal and the errors to be asserted to the Board.
